Terms of Use
By downloading, installing or using the Capybara Cards mobile application ("App") you agree to these Terms. If you do not agree, please do not use the App.
1. Who can use the App
- You are at least 12 years old
- You have the legal capacity to enter into this agreement
- You will use the App in accordance with these Terms and applicable law
2. What the App is
Capybara Cards is a library of conversation question cards for couples, friends, family and groups, organised in themed decks (Couples, Gossip, Deep, Party, Friends). You can save favourite cards, follow a daily card and, with a subscription, unlock the full library. The App has no scoring, dares, challenges or drinking content: it is a set of prompts you talk about with someone next to you.
3. Subscriptions
Plans and renewal
- Capybara Cards offers auto-renewing subscriptions managed through your Apple ID. Current prices are shown in the App in your local currency.
- Payment is charged to your Apple ID at confirmation of purchase. Subscriptions renew automatically at the same price unless cancelled at least 24 hours before the end of the current period; renewal is charged within 24 hours before the period ends.
- Any free trial converts to a paid subscription unless cancelled before the trial ends.
Cancelling
iPhone Settings → your name → Subscriptions → Capybara Cards → Cancel. Cancellation takes effect at the end of the current period; you keep access until then. Unused time is not refunded.
Refunds
All purchases are made through Apple, and refund requests are decided by Apple under the App Store terms (reportaproblem.apple.com). Capybara Cards cannot issue refunds directly.
4. Content and intellectual property
All content in the App (questions, deck designs, illustrations, the capybara characters, branding and code) belongs to Capybara Cards and is protected by copyright and other intellectual-property laws.
You may use the App for personal, non-commercial purposes and share individual cards in personal social posts. You may not reproduce, distribute or sell the content, build competing products from our questions, reverse-engineer or modify the App, or use our brand, logo or characters in your own products.
5. Acceptable use
- Do not use the App to harass, threaten or harm anyone, or share content in a way that violates someone's privacy
- Do not attempt to access paid content without a subscription or bypass technical restrictions
- Do not use bots or scrapers to extract content
6. Content disclaimer
The cards are conversation prompts for connection and fun, not professional advice. Some touch on relationships, feelings and intimacy; you decide what to answer and what to skip. The App is not a substitute for therapy, counselling or medical advice.
7. No warranty; limitation of liability
The App is provided "as is" without warranties of any kind. We do not guarantee uninterrupted service or any particular outcome from using the App. To the maximum extent permitted by law, Capybara Cards is not liable for indirect, incidental or consequential damages, for damages arising from your use of or inability to use the App or its content, or for disputes between people using the App. Our total liability for any claim is limited to what you paid for your subscription in the previous 12 months.
8. Privacy
How we handle data is described in our Privacy Policy, which forms part of these Terms.
9. Termination
We may suspend or end your access if you breach these Terms, misuse the App or its content, or where the law requires. You may stop using the App at any time by uninstalling it; subscriptions are cancelled through Apple as described above.
10. Changes to these Terms
We may update these Terms; the date at the top will change and material changes will be announced in the App. Continued use after a change means you accept the updated Terms.
11. Governing law
These Terms are governed by the laws of Türkiye, and disputes are resolved in the courts of İstanbul, Türkiye. If you live elsewhere, mandatory consumer-protection rules of your country may also apply.
12. Apple-specific terms
Because the App is distributed through the Apple App Store: these Terms are between you and Capybara Cards, not Apple; Apple is not responsible for the App or its content and has no obligation to provide support; if the App fails to conform to an applicable warranty you may notify Apple, which may refund the purchase price, and Apple has no other warranty obligation; Apple is a third-party beneficiary of these Terms and may enforce them; you confirm you are not located in a country subject to a U.S. embargo or listed as a "terrorist supporting" country, and are not on any U.S. government list of prohibited or restricted parties.
